WEDDING PHOTOGRAPHY - TERMS & CONDITIONS
In the following terms & conditions “the photographer(s)” shall mean Paul Walker Photography. “The client(s)” shall be those persons defined as bride and groom on the booking form. These terms & conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.
1. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
2. Booking Fee
The Booking Fee (deposit) of £200 may be made by BACS online money bank transfer (preferred), or a cheque made payable to Paul Walker, or by cash, and secures the time and services of the Photographer(s) for the wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the Photographer due to cancellation. Cancellation less than 12 weeks before the wedding will result in the payment in full. All cancellations must be in writing. Weddings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time. Deposits are only available on values of £400 and over, sums below this figure require full payment on booking to secure the wedding date.
3. Payments
Following payment of the Booking Fee, the balance is due 1 month before the wedding date. No Photographs, Storybooks, Disks or Optional Extras will be delivered until all payments due have been paid in full. If final balances are not paid four weeks before the wedding date the photographer(s) reserve the right to cancel the booking and not attend the event. Payment for Reprints, Digital Story Books, Thank You Cards, Acrylic Panels, Canvas Prints, or other Optional Extras is to be made in full at the time of ordering. Payment for additional Attendance Hours (part or whole at £95 per hour) were agreed, but which may not be known accurately at the time of booking, must be made at the post-wedding delivery meeting.
4. Prices
All prices are as at the time of booking, but in the event that changes arise that are outside the Photographer(s) control, for instance, but not exclusively, the costs of Prints, Optional Extras, Travel and Subsistence, then we will inform the Client of such within 21 days.
5. Photographer(s)
The Principal Photographers will be Paul Walker or Greg Smith, and where they deem appropriate, a 2nd Photographer of their choice will be provided at no extra cost. They will be the ONLY stills Photographers allowed to attend for financial gain. (Videographers attendance by agreement.)
Paul Walker Photography has various photographers: All photographers are experienced, professional photographers. Unless requested on booking any one of the photographers may be a signed to your wedding booking.
6. Images
All image sizes are nominal. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye. The number and style of photographs delivered to the client by the Photographer shall be deemed correct. An unlimited amount of photographs will be taken on the day this amount will differ depending on the length of time and number of guests.
For a booking involving a church ceremony or at certain venues, the photographer’s movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the ceremony may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case.
Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure or human error. If for any reason, human error is at fault and images are compromised, The Photographer(s) will set in place a compensation package mutually agreeable by both parties.
Delivery of final images: Images go into our workflow queue and all weddings are edited in date order, this whole process from start to finish takes on average 4-6 weeks. However, we do try for sooner but cannot guarantee this because of the number of weddings we attend.
7. Creative Licence
The Photographer(s) shall be granted artistic licence in relation to the poses photographed and the locations used. The style and the number of photographs are also dependent on the vagaries of the weather and the availability and willingness of the clients and their guests. The Photographer(s) will make their best effort to honour requested photographs but does not undertake any guarantee for any specific picture nor incorporate any specific background, location or group arrangement.
The photographer shall be granted artistic license in relation to the poses photographed and the locations used. The photographer’s judgement regarding these matters shall be deemed correct.
The photographer shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out.
8. Display
The Photographer may display any photographs included in their studio, web site, portfolio, literature, display areas, exhibitions, competitions, advertising or slide shows unless expressly denied in writing by the Client. NO other persons except the client(s) will have rights to use or display any photographs unless written permission has been granted by The Photographer(s).
9. Retouching
Retouching, digital manipulation and artist finishing is included in all packages where the fault lies with the photographer. Any client requested image manipulation will be charged at an agreed hourly rate. A small selection of digital manipulation images will be produced as an example of possibilities, additional requests are pre-quoted.
10. Copyright
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are the copyright of the client and Paul Walker Photography, NO other persons will have rights to use or display any photographs unless written permission has been granted by Paul Walker Photography. All images can be copied photographically, electronically or by any other means, an image created as part of this contract without the permission of The Photographer(s) in terms of client usage. Negatives/Digital files remain the property of The Client.
11. Licensed Images
Images supplied by The Photographer(s) on a Disk/USB as jpeg format digital files will be of sufficient resolution for printing up to size [A4/A3/A2]. They are licensed to you for sharing or displaying electronically with Family and Friends, and for printing by the Bride and Groom and guests.
12. Third-Party Printing
The Photographer(s) cannot accept any responsibility or liability for colour balance or quality of any Prints reproduced from the Disk that we supply by Third Party Printers such as High Street photo-processing shops and home printers.
13. Attendance
In the unlikely event of the assigned Photographer being unable to attend your wedding, the photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, a victim of crime, flooding etc.
14. Travel and Subsistence
For attendance at venues at a distance over 60 miles radius from either HD1, M1 or S40 postcodes, travel costs at the rate of £0.65 per mile will be charged where appropriate. Where the wedding and ceremony require an overnight or longer stay, whether in the UK or overseas, then modest hotel and subsistence charges will be made.
15. Limitation of Liability
In the unlikely event of total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
16. Force Majeure (Act of God)
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
18. Pre Wedding Meetings (for discounted offers, please see clause 19)
Clients within a 5 mile radius will be visited at home for their pre-wedding consultation. Distances greater than a 5 mile radius will be conducted over the telephone. Alternatively, if face to face is preferred, we can conduct the meeting over Skype.
19. Packages
Four package options are available, Gold, Gold Album and Platinum, Platinum Album. All packages start with photographs at the brides' departure point, this is a 30 minute shoot and is directly before the photographer photographs guests arriving at the ceremony venue. The Gold package ends 10 minutes after guests, bride and groom are seated for the wedding breakfast, the platinum continues after the meal to include speeches, the arrival of evening guests and concludes with capturing the first dance. All duration times set out are a guide only so morning weddings are catered for. The total length of attendance includes travelling time from HD5 postcode and arrival back at HD5 postcode. Additional hours photography may be available at £60 per hour. Payment of any additional hours is required before the event.
19.1 Cancelation or Postpone
The Client may cancel this contract at any time by giving written notice to The Photographer(s), should the booking be cancelled, the following payments shall be returned to the client. All deposits are non-refundable.
If '3 Easy Pays' payment option is selected, the first initial payment is classed as the deposit and is non-refundable. Cancellation within 6 weeks of wedding – 0%, 7-14 weeks – 25%, 15-20 weeks – 50%, 21-35 weeks – 75%, over 35 weeks - 80%. Should 'the photographer' cancel the booking, all monies paid, will be refunded in full.
If full payment is made at the time of booking, £80 is deducted from to full price paid to cover administrations costs, thereafter, the following monies shall be returned to the client: Cancellation within 6 weeks of the wedding – 0%, 7-14 weeks – 25%, 15-20 weeks – 50%, 21-35 weeks – 75%, over 35 weeks - 80%. Should a client wish to postpone their wedding date and change the date, this can be carried out without any additional charge, however, any monies owed by means of a balance has to be paid 4 weeks before the original (first date).
All refunds will be paid into the account previously paid from unless otherwise requested and shall be paid 30 days after the time of cancellation.
19.11 - Payment defaults
All bookings are subject to payment of an invoice within 24 hours of bookings. Bookings are not confirmed in the diary until payment has been received. After 24 hours, automated reminders for the booking fee will be sent out for one week. After 7 days, a final reminder will be sent out with a 24 hour extension to pay. After this period, “the photographer(s)” will cancel the booking on the assumption that the client does not wish to proceed.
In the event that part payments have already been paid: If '3 Easy Pays' payment option is selected, the first initial payment is classed as the deposit and is non-refundable. If final balances are not paid, no refund will be made and attendance to the event will be cancelled.
If an extension or an alternative payment plan has been granted: This must be honoured, failure to make a payment on a specified date will result in termination of the booking with no refunds.
19.2 Special offers
All monthly offers are only valid for the month of the offer. Prize draw: See specific terms & conditions relating directly to that offer/draw.
January Free Fame offer: this offer is only available to clients booking within the month of January.
20. Complaints
Any complaints should first be raised by the Client with the Photographer in writing within 21 days from the date of receipt of images. The photographer has to respond to any complaints with resolutions within 21 days of any complaint made against him. In the unlikely event of an unresolved complaint, the Client may request the Society of Wedding and Portrait Photographers (SWPP) to mediate but only on the basis that its decision shall be final and binding upon both parties
